Nicholas Soames: To ask the Secretary of State for Communities and Local Government what steps he is taking to ensure that developers abide by planning conditions. [175622]

Nick Boles, Parliamentary Under Secretary of State for Planning: Monitoring of compliance with conditions attached to planning permissions is a matter for the local planning authority. Local planning authorities adopt various strategies to do this, including, for example, asking developers to notify them of the start of works, so that pre-commencement conditions can be checked. If a developer fails to comply with a condition, the local planning authority may serve a breach of condition notice requiring compliance. If a breach of condition notice is not complied with, the person responsible for the breach can be prosecuted in the magistrates court where the penalty is a fine of up to £2,500 on conviction.
